Which State Has the Highest Estate Tax in 2026?

Two different answers, depending on what you mean. By top rate, Washington and Hawaii lead at 20%. By what an estate actually pays, the answer changes with the size of the estate: Oregon is the most expensive at both $3M ($205,000) and $5M ($425,000), and Washington at $10M ($1,400,000). Thresholds matter more than rates for most estates.

Rate alone is a poor guide: the two states with the highest rate have exemptions of $3,000,000 and $5,490,000, while the state with the lowest exemption, Oregon, tops out at 16%.

Washington's rate depends on the date of death. Deaths before July 1, 2025: top rate 20%, exemption $2,193,000; Deaths July 1, 2025 – June 30, 2026 (temporary spike): top rate 35%, exemption $3,076,000; Deaths on/after July 1, 2026 (SB 6347): top rate 20%, exemption $3,000,000. For a death in the twelve months to June 30, 2026, Washington stood alone at 35% — the highest state estate tax rate in the country at the time.

What the rankings mean

Oregon is the most expensive state for estates under about $5 million for one reason: a $1,000,000 exemption that has not moved in years. Washington overtakes it for larger estates because its rate is higher, and New York's cliff pushes it into the top three at $10 million even though it collects nothing at $5 million. At the other end, Connecticut collects nothing on any of these estates — its exemption matches the federal one.
